Introduction

Welcome to VG Auction. By using the services at www.VGauction.com you are agreeing to the following terms, conditions, and principles. This website is intended to be a friendly and helpful resource for buying and selling.

Before you become a member of VG Auction (VGA), you must read and accept all the terms and conditions in this user agreement and privacy policy. Read and understand all terms before joining.

General Terms

This site is a venue to allow anyone to buy, sell, and offer video game and computer related items, accounts, services, and currency, from anywhere, in a variety of pricing formats and venues, such as fixed price formats and auction style formats. VGA is not involved in the transactions between buyers and sellers. VGA has no control over, and does not guarantee the quality, safety, or legality of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will complete a transaction. Please note there are risks in dealing with foreign nationals, underage persons, and people acting under false pretense.

VG Auction is not held responsible for other user�s actions or inactions, including items posted. VGA is not an auctioneer. VGA is not liable for any loss of monies, goodwill, reputation, indirect damages, or consequential damages, arising out of the use of this site. VGA will not be held responsible for damage to items during transit nor for misrepresentations and/or breaches of contract by either buyer or seller, the cost of procurement of substitute goods, or any losses resulting from any goods purchased or obtained. This site assumes no liability for the content of the listings.

User Conduct

The buyer/seller is solely responsible for the contents of their actions through the use of this website. The buyer/seller must ensure that participation in the buying and selling of items does not violate any applicable laws or regulations. The buyer/seller must not use these services to transmit any unlawful, harassing, abusive, libelous, threatening, vulgar, harmful, obscene, or otherwise objectionable material. The buyer/seller must also refrain from posting any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law or regulation.

Using VG Auction

While using the site, the buyer/seller will not:

violate any laws;
use this site if you are not able to form legally binding contracts, are under the age of 18 (all parents/guardians are held accountable for minors� actions);
use this site if you are temporarily or permanently suspended from using this site;
fail to deliver payment for items purchased (unless the seller has materially changed the item�s description after your bid, a clear typographical error is made, or you cannot authenticate the seller�s identity);
fail to deliver items purchased (unless the buyer fails to meet the posted terms, or you cannot authenticate the buyer�s identity);
manipulate the price of any item or interfere with other user�s listings;
circumvent or manipulate VGA's fee structure, billing process, or fees owed to VG Auction;
post false, inaccurate, defamatory, misleading, or libelous content (including personal information);
take any action that may undermine feedback or rating systems;
transfer your VG Auction account (including feedback and User ID) to another party without VGA's consent;
distribute or post spam, pyramid schemes, or chain letters;
distribute viruses, spyware, or any other technologies that may harm VG Auction, or the interests and property of VG Auction users;
harvest or collect information about users, including email addresses, without the user's consent;
interfere, or attempt to interfere, with the proper workings of this site, or any activities conducted on this site;
anonymously connect to VGA's servers;
use spoofing programs (we block open proxies).

Rights to Suspend or Terminate

VG Auction's goal is to keep this site working properly and the User Community safe. Please report problems, offensive content, and policy violations through VGA's abuse report system and/or VGA's user dispute system.

Without limiting other remedies, VGA may limit, suspend, or terminate this service and user accounts, prohibit access to this website, remove hosting content, and take technical and legal steps to keep users off this site if VGA thinks that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of VGA's policies.

Fees and Services

Joining VG Auction, bidding on listed items, and posting standard listings are free. VGA does charge fees for using other services, such as Home Page Featured Auctions, SMS Text Message Alerts, Store Account Fees, Second Category Fees, Additional Pictures Fee, Highlighted Items Fee, Bold Items Fee, Category Featured Item Fees, Wanted Ad Setup Fees, and End of Auction Fees. When using a service that has a fee, you have an opportunity to review and accept the fees that will be charged based on VGA's Site Fees. VGA may change fees from time to time. Changes to this Policy are effective after VGA provides you with at least fourteen days� notice by posting the changes on this Site. VGA may choose to temporarily change the fees for services for promotional events or new services, and such changes are effective when posted.

Unless otherwise stated, all fees are quoted in U.S. Dollars. The user is responsible for paying all fees and applicable taxes associated with this site in a timely manner, and with a valid payment method. If your payment method fails, or your account is past due, VGA may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, and retaining collection agencies and legal counsel.)

The credit accumulated on an account for registering a sellers account, referring users that register a sellers account, and/or any other site promotions may only be used for VG Auction Site Fees. In other words, this credit is nonredeemable.
